Child pornography is prohibited criminal content and its distribution is subject to criminal procedures and sanctions in Canada and in other jurisdictions.
In the copyright context, many countries, including Canada, provide civil enforcement measures to combat the online distribution of pirated content that, while not criminal in nature, infringes copyright owners’ rights. In some countries, these measures take the form of notice obligations and takedown procedures.
We do not know why a “removed because of copyright” notice might have appeared in the context of removing child pornography. Canada’s Copyright Act does not prescribe what information (if any) should be contained on a website notice for content that has been removed, either for copyright reasons or for other reasons.
